Enforcement procedure

If, after making a request for accessible information or a complaint, it has been rejected, the person concerned does not agree with the decision taken, or the response does not meet the requirements set out in article 12.5, the interested party may initiate a claim. A claim may also be initiated if twenty working days have passed without a response being received.

The claim may be submitted through the General Application of the electronic headquarters of the Ministry of Economic Affairs and Digital Transformation, as well as through the other options set out in Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations. Claims will be received and handled by the Deputy Directorate General for Service Inspection of the Ministry.
